Article 3 – Applicability
These general Terms and Conditions apply to every offer made by Maeravelle and to every distance contract concluded between Maeravelle and the consumer.
Before a distance contract is concluded, the text of these Terms and Conditions will be made available to the consumer. If this is not reasonably possible, the consumer will be informed before the contract is concluded that the Terms and Conditions can be consulted and will be sent free of charge upon request.
If the distance contract is concluded electronically, these Terms and Conditions will be made available electronically before the contract is concluded, in such a way that the consumer can easily store them on a durable medium. If this is not reasonably possible, the consumer will be informed where the Terms and Conditions can be consulted electronically and that they will be sent free of charge upon request.
If specific product or service conditions apply in addition to these general terms, the preceding provisions apply accordingly. In the event of conflicting conditions, the consumer may rely on the provision most favorable to them.
If any provision of these Terms and Conditions is wholly or partially null and void at any time, the contract and the remaining terms will remain in effect, and the invalid provision will be replaced by a provision that approximates its original intent as closely as possible.
Situations not covered by these Terms and Conditions will be assessed in accordance with their general principles.
Ambiguities regarding the interpretation or content of one or more provisions will be interpreted in accordance with the purpose and spirit of these Terms and Conditions.
Article 4 – The Offer
If an offer is subject to a limited validity period or specific conditions, this will be explicitly stated in the offer.
The offer is non-binding. Maeravelle reserves the right to modify or withdraw an offer, subject to applicable law.
The offer includes a complete and accurate description of the products and/or services. The description is sufficiently detailed to allow the consumer to make a proper assessment. Images, where used, are intended to represent the products or services accurately. Obvious errors or mistakes do not bind Maeravelle.
Product images and specifications are provided for illustrative and informational purposes. Colors may vary slightly from the actual products due to screen settings and other factors.
Each offer contains sufficient information for the consumer to understand their rights and obligations upon acceptance, including:
- The price, including any applicable taxes and any additional charges that may apply.
- Any shipping costs.
- The manner in which the contract is concluded and the actions required.
- Whether the right of withdrawal applies.
- The available payment methods and the terms of delivery and performance of the contract.
- The period during which the offer may be accepted or the period for which the price is guaranteed.
- Any communication costs, if calculated differently from the regular basic rate.
- Whether the contract will be archived and how it can be accessed by the consumer.
- How the consumer can check and correct the information provided before concluding the contract.
- The languages in which the contract may be concluded.
- Any applicable codes of conduct and how they can be accessed.
- The minimum duration of the distance contract in the case of continuous transactions.
-
Where applicable, available product sizes, colors, and materials.
Article 5 – The Agreement
Subject to the provisions of these Terms and Conditions, the agreement is concluded once the consumer accepts the offer and meets the stated conditions.
If the offer is accepted electronically, Maeravelle will confirm receipt of the acceptance electronically without undue delay. Until confirmation of receipt has been provided, the consumer may dissolve the agreement where applicable.
If the agreement is concluded electronically, Maeravelle will take appropriate technical and organizational measures to secure electronic data transfers and provide a secure online environment. If electronic payment is available, appropriate security measures will be implemented.
Maeravelle may, within the limits of applicable law, assess whether the consumer can meet their payment obligations. If there are reasonable grounds, Maeravelle may refuse an order or attach special conditions to its execution.
Maeravelle will provide the following information to the consumer in writing or on a durable medium, where required by applicable law:
-
The business address to which complaints may be submitted.
-
The conditions and procedure for exercising the right of withdrawal, or a clear statement where this right does not apply.
-
Information about applicable guarantees and after-sales service.
-
The relevant information referred to in these Terms and Conditions, unless it has already been provided to the consumer.
-
The conditions for terminating the agreement if it has an indefinite duration or lasts longer than one year.
For continuous transactions, the above information applies to the first delivery, where applicable.
The agreement is concluded subject to product availability. If a product becomes unavailable after an order has been placed, Maeravelle will inform the consumer and provide an appropriate solution in accordance with applicable law.
Article 6 – Right of Withdrawal
Where applicable consumer protection law provides a right of withdrawal, consumers may withdraw from the contract within 14 days without giving a reason. This period generally begins on the day after the consumer, or a third party designated by the consumer other than the carrier, receives the product.
During the withdrawal period, the consumer must handle the product and its packaging with reasonable care. The product may only be unpacked or used to the extent necessary to establish its nature, characteristics, and functioning.
If the consumer exercises the right of withdrawal, the product should be returned with all supplied accessories and, where reasonably possible, in its original condition and packaging, following the return instructions provided by Maeravelle.
To exercise the right of withdrawal, the consumer must notify Maeravelle within the applicable withdrawal period, preferably in writing by email at hey@maeravelle.com. Unless otherwise required by law, the consumer must then send the product back within 14 days of notifying Maeravelle of the withdrawal.
The consumer should retain proof of return shipment. Any statutory rights that apply remain unaffected by these terms.
Article 7 – Costs in Case of Withdrawal
Unless applicable law provides otherwise, the consumer is responsible for the direct cost of returning a product when exercising the right of withdrawal.
Maeravelle will reimburse eligible payments in accordance with applicable law. Where required, reimbursement will be made within 14 days of receiving the withdrawal notification. Maeravelle may withhold reimbursement until the returned product has been received or the consumer has provided proof that it has been sent back, whichever occurs first.
Any reimbursement will include applicable delivery costs to the extent required by law. Additional costs arising from the consumer's choice of a delivery method more expensive than the least expensive standard delivery option offered by Maeravelle may be excluded where permitted by law.
Article 8 – Exclusions from the Right of Withdrawal
The right of withdrawal may be excluded for certain products or services only where permitted by applicable law and where the exclusion has been clearly communicated to the consumer before the order is placed.
Depending on the applicable legal requirements, exclusions may include:
-
Products made to the consumer's specifications or clearly personalized.
-
Products that are liable to deteriorate or expire rapidly.
-
Sealed products that are not suitable for return for health protection or hygiene reasons, where the seal has been broken after delivery.
-
Sealed audio or video recordings or sealed computer software where the seal has been broken after delivery.
-
Newspapers or magazines, except where applicable law provides otherwise.
-
Products or services whose prices depend on financial-market fluctuations beyond the entrepreneur's control, where a statutory exclusion applies.
-
Other products or services for which an exclusion is expressly permitted by applicable law.
Where permitted by law, the right of withdrawal may also be excluded for certain services, including:
-
Accommodation, transport, catering, or leisure services provided on a specific date or during a specific period.
-
Services that have been fully performed after the consumer has given the required prior express consent and acknowledged the loss of the right of withdrawal, where applicable.
-
Other services for which applicable law expressly permits an exclusion.
Nothing in this section limits any mandatory consumer rights.
Article 9 – Prices
During the validity period stated in an offer, the prices of the products and services offered will not be increased, except where changes are permitted by applicable law, including changes resulting from adjustments to applicable tax rates.
Products or services with variable prices subject to financial-market fluctuations beyond Maeravelle's control may be offered at variable prices where permitted by law. Any relevant fluctuations and pricing conditions will be stated clearly in the offer.
Price increases within three months after the conclusion of an agreement are permitted only where required or authorized by applicable law.
Price increases after three months are permitted only where allowed by law and, where required, agreed with the consumer. If the consumer is entitled to cancel the agreement because of a price increase, Maeravelle will communicate the applicable cancellation conditions.
The prices displayed on the website will indicate applicable taxes and additional charges as required by the laws governing the sale. Where import VAT, customs duties, or clearance fees may be payable by the customer, this information will be disclosed before purchase to the extent required by law.
Maeravelle makes reasonable efforts to ensure that all prices are accurate. If a clear pricing or typographical error occurs, Maeravelle reserves the right to correct it. If an order is affected by a material pricing error, the customer will be informed and offered an appropriate solution in accordance with applicable law.
Article 10 – Legal Notice

Article 10 – Conformity and Warranty
Maeravelle guarantees that its products and/or services comply with the agreement, the specifications stated in the product offer, reasonable usability and fitness requirements, and applicable legal provisions in force at the time the agreement is concluded. Where expressly agreed, Maeravelle also guarantees that a product is suitable for a purpose other than its normal intended use.
Any commercial warranty provided by Maeravelle, a manufacturer, or an importer does not affect the consumer’s statutory rights and remedies under the agreement or applicable law.
Defects or incorrect deliveries should be reported to Maeravelle in writing as soon as reasonably possible after delivery. Customers are encouraged to provide a clear description of the issue and, where appropriate, supporting photographs. Products should be returned in their original packaging and unused condition where reasonably possible, without limiting any statutory consumer rights.
Any commercial warranty offered by Maeravelle will be subject to the terms communicated with the relevant product. This does not limit any mandatory statutory warranty or consumer protection rights. Maeravelle cannot guarantee that a product will be suitable for every individual application unless this has been expressly agreed.
A commercial warranty may not apply where:
-
The consumer has repaired or modified the product, or arranged for a third party to do so, without authorization, where this has caused or contributed to the defect.
-
The product has been exposed to abnormal conditions, handled carelessly, or used contrary to the provided instructions, where this has caused or contributed to the defect.
-
The defect results from applicable government requirements concerning the materials used, to the extent permitted by applicable law.
Nothing in this article excludes or limits rights that cannot legally be excluded or limited.
Article 11 – Delivery and Execution
Maeravelle will exercise reasonable care when receiving and processing orders for products.
Delivery will be made to the address provided by the consumer during checkout, subject to the applicable shipping terms.
Subject to Article 5 of these Terms and Conditions, Maeravelle will process and fulfill accepted orders as promptly as reasonably possible and within the delivery period stated at checkout or in the relevant shipping policy. Where applicable law requires delivery within a specific period, that requirement will apply. If delivery is delayed or an order cannot be fulfilled, the consumer will be informed as soon as reasonably possible and will be entitled to any cancellation, refund, or other remedies required by applicable law.
If an agreement is lawfully cancelled because of non-delivery, Maeravelle will refund amounts paid for the affected order within the period required by applicable law.
If an ordered product becomes unavailable, Maeravelle may contact the consumer to discuss an appropriate alternative or refund. A replacement will only be provided in accordance with applicable law and any agreement with the consumer. The consumer’s withdrawal and return rights will not be restricted unlawfully, and Maeravelle will bear return costs where required by law or where the replacement was supplied in error.
The risk of damage to or loss of products remains with Maeravelle until the consumer, or a person designated by the consumer other than the carrier, takes physical possession of the products, unless applicable law provides otherwise.
Article 12 – Subscriptions: Duration, Termination and Renewal
Termination
Where Maeravelle offers a subscription or an agreement for recurring deliveries, consumers may terminate it in accordance with the terms disclosed at the time of purchase and applicable law.
For subscriptions of indefinite duration, consumers may terminate at any time subject to any lawful notice period disclosed before purchase.
For fixed-term subscriptions, termination and renewal will be governed by the terms presented to the consumer before the agreement is concluded and by applicable law.
Where permitted by law, consumers may terminate a subscription:
-
In accordance with the cancellation method disclosed when the subscription was purchased.
-
Subject to the applicable notice period and any mandatory consumer protection requirements.
Renewal
Maeravelle will clearly disclose whether a subscription renews automatically, its duration, its renewal terms, and how it can be cancelled before the consumer purchases it.
Automatic renewal will only be used where permitted by applicable law and where the consumer has received the required information and consented to the arrangement.
Consumers may cancel automatic renewals in accordance with the disclosed subscription terms and applicable law.
Duration
For agreements lasting more than one year, consumers may have additional termination rights under applicable law. Any such rights will be respected.
Note: If Maeravelle does not offer subscriptions or recurring deliveries, this article may not be necessary and should be reviewed for removal.
Article 13 – Payment
Unless otherwise stated at checkout, payment is due according to the payment terms displayed when the order is placed.
The consumer must promptly notify Maeravelle if they identify an error in their payment information or transaction details.
If a consumer fails to make a payment when due, Maeravelle may take appropriate action and charge reasonable costs only where permitted by applicable law and where the relevant charges and conditions have been properly disclosed.
Available payment methods and any applicable payment conditions will be displayed during checkout.
Article 14 – Complaint Procedure
Complaints concerning an order, product, or the performance of an agreement should be sent to Maeravelle at hey@maeravelle.com. Consumers are encouraged to provide their order number, a clear description of the issue, and any relevant supporting information.
Maeravelle aims to acknowledge and respond to complaints within 14 days of receipt. If a complaint requires more time to investigate, Maeravelle will inform the consumer within that period and provide an estimated timeframe for a further response.
If a complaint cannot be resolved directly, the consumer may pursue any dispute-resolution options available under applicable law.
Submitting a complaint does not suspend either party’s obligations unless otherwise agreed in writing or required by law.
Where a complaint is upheld, Maeravelle will offer an appropriate remedy, such as repair, replacement, refund, or another remedy required by applicable consumer protection law.
